شورای امنیت سازمان ملل متحد و مسئله تعارض اصل حق تعیین سرنوشت ملت‌ها با اصل حق حاکمیت ملی: مورد کوزوو

چکیده

دو اصل حق تعیین سرنوشت و حق حاکمیت ملی از مهمترین اصول بنیادین حاکم بر سازمان ملل متحد است که به طرق مختلف از جمله در منشور این سازمان (بند 2 از ماده 1، بندهای 1، 4 و 7 از ماده 2، بند 3 از ماده 55، مواد 73-74 و ماده 77)، میثاق حقوق بشر سال 1966 سازمان و قطعنامه‌های شورای امنیت (از جمله قطعنامه‌های 1514و 1803) آن مورد تصریح و تأکید قرار گرفته است. اما با گذشت زمان و بروز تحولاتی در عرصه بین‌المللی، تعارض میان این دو اصل بیش از پیش آشکار شده است. برای نمونه مطالعه تحولات کوزوو نشان می‌دهد صدور یکجانبه اعلامیه استقلال این منطقه از سوی پارلمان کوزوو، در تعارض آشکار با حاکمیت ملی یوگسلاوی قرار گرفته و شورای امنیت سازمان ملل متحد با وجودی که در تمامی قطعنامه‌های 1169، 1199، 1239، 1244 و دیگر اسناد و اقدامات خود که برای حل بحران میان کوزوو و صربستان صادر و پیگیری نموده همواره بر لزوم احترام به این دو اصل در قالب شناسایی حق حاکمیت ملی یوگسلاوی و حق تعیین سرنوشت مردم کوزوو تصریح نموده، در عمل از مداخله نظامی ناتو در یوگسلاوی جلوگیری نکرد، آن را تقبیح ننمود و در نتیجه حاکمیت ملی یوگسلاوی مخدوش گردید. رأی مشورتی 22 جولای 2010 دیوان بین‌المللی دادگستری نیز که بنا به درخواست و پیگیری‌های این سازمان صادر شد و همچنین قطعنامه مجمع عمومی سازمان در 13 اکتبر 2010 مبنی بر عدم مغایرت اعلام یکجانبه استقلال از سوی کوزوو با حقوق بین‌الملل، هم به نوعی این ترجیح سازمان در حق تعیین سرنوشت کوزوو را نسبت به حاکمیت ملی یوگسلاوی تأیید نمود. این مقاله با مراجعه به اسناد سازمان ملل متحد و اقدامات شورای امنیت و دیگر ارکان آن و همچنین اقدامات صورت گرفته از سوی جامعه بین‌المللی برای حل و فصل بحران کوزوو، تلاش می‌کند تا تعارض میان دو اصل حق تعیین سرنوشت ملت‌ها و حق حاکمیت ملی را در رویه سازمان ملل متحد بررسی و علت ترجیح یکی بر دیگری را تحلیل نماید.

UN Security Council and the Problem of inconsistency between the Principles of Nations` Self-Determination Right and the Right of National Sovereinty: the Case of Kosovo

The two principles of the right to self-determination and the right of national sovereignty are the most fundamental principles governing the United Nations that are emphasized through various ways including the UN Charter (Articles 1(2), 2(1, 4, 7), 55(3), 73-74 and 77), UN covenants on human rights of 1966 and the Security Council’s resolutions (such as resolutions 1514 and 1803). Nevertheless, the conflict between the two principles has been erupted over time in a variety of situations in international arena. In the case of Kosovo, as an example, the parliament of Kosovo issued a unilateral declaration of the regional independence in an apparent conflict with the national sovereignty of former Yugoslavia; and the UN Security Council who had always highlighted, in its resolutions of 1169, 1199, 1239, 1244 and other documents released to solve the crisis between Yugoslavia and Kosovo, the need to respect the two principles in the form of recognizing Yugoslav national sovereignty and the right of Kosovan people to self-determination, did not in practice either prevent NATO military intervention in Yugoslavia or even condemn it and thus the Yugoslav national sovereignty eventually altered. Advisory vote of International Court of Justice on 22 July 2010 and the follow-up resolutions of General Assembly on 13 October 2010 approving the unilateral declaration of independence by Kosovo Parliament were all in support of Kosovo right of self-determination against the national sovereignty of Yugoslavia. Referring documents released and action taken by the UN and its other principle organs as well as other international entities to resolve the Kosovo crisis, this paper seeks to study the conflict between the two principles and analyze the situation in which one is preferred over the other.
