Pakistan and Comoro have the same Islamic governmental system but are not considered in this study since it is very difficult to compare five countries in an article. Iran, Afghanistan and Mauritania have considerable distinctions despite their common points including the official religion, necessity to adjust laws with Islamic principles and the condition of being Muslim to become president; an issue arisen from two different perspectives while having common belief in Islamic values: a perspective interpreted in Iran as “the maximum presence of religion in the society” and therefore the legal system; and in Mauritania and Afghanistan as “the balance among Islamic teachings, democracy and human rights”. Our main argument in this article is that the governmental/state framework of the Islamic republic is capable of maximum compatibility with democratic musts and international human rights requirements and it may be called the integration of religion and democracy.}, keywords = {Islamic Republic,Islam,Constitution,Iran,Afghanistan,Mauritania}, title_fa = {مسأله‏ یابی اسلامی در قوانین اساسی سه جمهوری اسلامی: ایران، افغانستان و موریتانی (مطالعۀ تطبیقی)}, abstract_fa = {از میان دولتهایی که تاکنون نظام جمهوری اسلامی را به عنوان قالب حکومتی خود پذیرفته‏اند، موریتانی به عنوان مبدع این نظام و ایران و افغانستان از جهت رویکرد به اسلام و میزان نفوذ آن در نظام حقوقی در این نوشتار مورد نظر قرار گرفته‏ و کشورهایی چون پاکستان و کومور به جهت اجتناب از اطالۀ کلام و صعوبت مطالعه تطبیقی در بیش از سه کشور از حیطۀ بررسی خارج گردیده است. ایران، افغانستان و موریتانی علیرغم اشتراکاتی همچون دین رسمی، لزوم مطابقت قوانین با اصول اسلامی و شرط مسلمانی رئیس جمهور، نقاط تمایز قابل تأملی دارند؛ امری که ناشی از دو نگاه متفاوت در عین اعتقاد مشترک به ارزشهای اسلامی است: نگاهی که در ایران به «حضور حداکثری دین در جامعه» و بالطبع نظام حقوقی و در موریتانی و افغانستان به «توازن میان آموزه‏های اسلامی، دموکراسی و حقوق بشر‏» تعبیر می‏شود. با عنایت به مطالعۀ تطبیقی پیش رو، به نظر می‏رسد قالب جمهوری اسلامی توان سازگاری حداکثری با بایسته‏های دموکراسی و حقوق بین‏الملل بشر را داشته و می‏توان از آن به تلفیق دین و دموکراسی یاد کرد.}, keywords_fa = {جمهوری اسلامی,اسلام,قانون اساسی,افغانستان,موریتانی}, url = {http://www.ipsajournal.ir/article_176.html}, eprint = {http://www.ipsajournal.ir/article_176_a6a55ecabbca52de98e2aea1b46b8871.pdf} }
